MIGA COFFEE ONLINE STORE TERMS AND CONDITIONS
GENERAL PROVISIONS
The MIGA COFFEE online store, operating at the address: migacoffee.pl, is run by Miga Coffee Roasters Ltd. based at Ocicka 7, 47-400 Racibórz, Poland, registered under NIP: 6392008725, REGON: 362907900.
These Terms and Conditions define the rules for making purchases in the MIGA COFFEE online store, including the rules and procedures for concluding distance sales contracts via the Store, as well as the procedure for complaints and the procedure for withdrawing from the contract by the Consumer.
This Regulation is the regulation referred to in Article 9 of the Act on Providing Services by Electronic Means of July 18, 2002 (i.e., Journal of Laws of 2020, item 344, as amended).
This Regulation applies to all Customers of the Store. All Customers are required to familiarize themselves with the provisions of the Regulation before making a purchase.
Each Customer is obliged to comply with the provisions of the Regulation. The sale takes place according to the version of the Regulation in force at the time of placing the order.
Each Customer has the possibility to read the Regulation at any time by clicking on the “Store Regulations” hyperlink on the website of the Store migacoffee.pl. The Regulation can be downloaded and printed at any time.
All information on the website of the Store migacoffee.pl regarding products (including prices) does not constitute an offer within the meaning of Article 66 of the Civil Code of April 23, 1964 (i.e., Journal of Laws of 2019, item 1145, as amended), but an invitation to conclude a contract, as per Article 71 of the Civil Code of April 23, 1964 (i.e., Journal of Laws of 2020, item 1740, as amended). By sending the Order Form, the Customer makes an offer to purchase the specified Product at the price and on the terms specified in the description.
DEFINITIONS

Regulation – this set of rules organizing the principles for using the Store’s Services by Customers.

Consumer (contracts concluded before January 1, 2021) – a natural person making a civil law contract through the Store, not directly related to their business or professional activity.

Consumer (contracts concluded from January 1, 2021) – for the purpose of this Regulation, a Consumer includes the following people:
- A natural person concluding a civil law contract through the Store, not directly related to their business or professional activity (so-called "Consumer in the strict sense").
- A natural person concluding a civil law contract through the Store, directly related to their business activity, where the contract is not of a professional nature for that person, especially in relation to the object of their business activity, as registered in the Central Register and Information on Business Activity – so-called "Entrepreneur on Consumer Rights".

Customer – a natural person (including a Consumer), who is at least 13 years old (with the consent of their legal representative), a legal entity, or an organizational unit not being a legal entity, granted legal capacity by separate regulations, using the Services provided by the Store.

Order Form – The Service available on the Store’s website, through which the Customer can make a purchase, including adding Products to the Cart and determining certain conditions of the Sale Agreement, such as delivery method and payment options.

Cart – The Store’s element where the Products selected by the Customer are visible, and where the Customer can modify the Order details, including the quantity of Products.

Store – The website owned by the Seller, available at the domain migacoffee.pl, through which the Customer can purchase Products from the Seller.

Seller – Miga Coffee Roasters Ltd., based at Ocicka 7, 47-400 Racibórz, entered in the business register maintained by the District Court in Gliwice, X Economic Department, under KRS: 0000583777, NIP: 6392008725, REGON: 362907900, which conducts business for profit or professional activity offering products for sale through its website.

Product – A movable item being the subject of a transaction between the Store and the Customer, the sales conditions of which are specified in the Order Form.

Sales Agreement – A distance sales agreement for Products concluded by the Customer through the Store, usually via the Order Form.
ORDER ACCEPTANCE AND FULFILLMENT
The condition for using the Store is to read and accept these Terms and Conditions. By placing an order, the Customer accepts the content of the Terms and Conditions.
Orders from Customers are accepted through the Order Form, submitted via the website migacoffee.pl or via email at biuro@migacoffee.pl, 7 days a week, 24 hours a day.
Orders are fulfilled by selecting the Products the Customer is interested in, clicking the "ADD TO CART" button next to the Product description, then from the "CART" section, filling out the Order Form, including the choice of delivery and payment method or choosing the option of cash on delivery, if available for the selected Product, and then confirming the purchase.
DELIVERY AND TRANSPORT COSTS
Order shipments in the Store are carried out via:
- Parcel lockers
- Courier service
Orders placed in the Store are processed only on working days. Orders placed on Saturdays, Sundays, and public holidays will be processed on the next working day.
The usual delivery time is 3 working days. The delivery time includes both the order fulfillment time and the expected delivery time, which usually takes from 24 hours for Poland.
The Seller is not responsible for delays caused by the carrier.
PAYMENT PROCESSING
The following payment methods are available in the Store:
- Cash on delivery
- Bank transfer to account: 89 1140 2004 0000 3202 7592 3408
- Online payment via Blue Media S.A. operator
A Customer choosing the bank transfer payment option must pay for the order within five (5) working days from the date of placing the order. Otherwise, the Seller’s offer is not binding, and the order will be removed from the system.
COMPLAINTS
The Seller is responsible for defects of the Product under warranty, as specified in Articles 556 and following of the Civil Code of April 23, 1964 (i.e., Journal of Laws of 2019, item 1145, as amended).
A physical defect of the Product is when the Product does not meet the conditions of the contract, such as:
- The Product does not have the properties it should have based on the purpose of the contract.
- The Product does not have the properties the Seller assured the Customer about.
- The Product is not fit for the purpose the Customer informed the Seller about at the time of the contract, and the Seller did not object to such use.
RIGHT OF WITHDRAWAL
Under the Consumer Rights Act of May 30, 2014 (i.e., Journal of Laws of 2020, item 287, as amended), the Consumer may withdraw from the sales contract of Products purchased in the Store without providing a reason by submitting a written declaration within fourteen (14) days from the date of delivery of the Product (i.e., from the day the Consumer receives the Product).
The Consumer may withdraw from the contract by submitting a statement to the Seller. The sample withdrawal form is Annex 1 to these Terms and Conditions.
